1 Acceptance of Terms

By accessing or using MushingPlan ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2 Eligibility

You must be at least 13 years old to use MushingPlan. By creating an account, you represent that you meet this age requirement and that all information you provide is accurate.

3 Description of Service

MushingPlan is a platform for dog mushing that provides GPS training tracking, kennel management, dog health records, and a tour/equipment marketplace. The Service includes a mobile application, website, and connected device integrations (wearable watches).

4 Accounts

You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized use. We are not liable for losses resulting from unauthorized account access that is not caused by our negligence.

5 GPS & Location Data Disclaimer

GPS data provided by MushingPlan is for informational and training purposes only.

  • GPS accuracy can be affected by terrain, weather, tree canopy, satellite geometry, and device limitations
  • Do not rely on MushingPlan GPS for safety-critical navigation in remote or wilderness areas
  • Always carry appropriate navigation equipment and safety gear independent of the app
  • We are not responsible for data loss during offline sessions due to device failure or battery depletion before sync

6 Wearable Device Data Disclaimer

Training metrics from connected wearable devices (Garmin, Apple Watch, and others) are approximate and not medical-grade measurements. Heart rate, speed, distance, and other fitness data should not be used as a substitute for professional medical advice. MushingPlan is not a medical device and does not provide medical diagnoses.

7 Dog Health Data Disclaimer

Health records, vaccination tracking, and wellness features are for record-keeping and informational purposes only. They do not constitute veterinary advice. Always consult a qualified veterinarian for medical decisions regarding your dogs.

8 Marketplace Terms

Platform Intermediary

MushingPlan facilitates but is not a party to transactions between users. We do not guarantee quality, safety, legality, or accuracy of listings.

Fees & Commissions

Fees are displayed before listing creation and on the seller dashboard. Fee changes will be communicated with at least 30 days notice.

Buyer Protections

EU consumers may have a 14-day withdrawal right for distance purchases, subject to applicable exceptions. Cancellation policies are displayed on each listing.

Disputes

We encourage direct resolution. MushingPlan may provide mediation and reserves the right to take action where terms are violated.

Seller Obligations

  • Provide accurate and truthful listing information
  • Accept and comply with Stripe's Connected Account Agreement
  • Comply with all applicable local laws, including licensing requirements
  • Handle their own tax reporting and obligations
  • Respond to buyer inquiries and honor confirmed bookings

Prohibited Items

  • Live animals (unless in compliance with all applicable local regulations)
  • Counterfeit or stolen goods
  • Items that violate applicable laws
  • Misleading or fraudulent listings

9 User-Generated Content

  • You retain ownership of content you create (photos, reviews, listings, messages)
  • By posting, you grant MushingPlan a non-exclusive, worldwide license to display, distribute, and store your content as necessary to operate the Service
  • You are responsible for ensuring your content does not infringe third-party rights
  • We reserve the right to remove content that violates these terms or applicable law
  • Abusive, fraudulent, or misleading reviews may be removed

10 Messaging Conduct

When using in-app messaging, you must not:

  • Send harassing, threatening, or abusive messages
  • Send spam or unsolicited commercial communications
  • Attempt to conduct transactions outside the platform to avoid fees
  • Share content that violates applicable law

11 Subscription & Payments

MushingPlan offers free and paid subscription tiers. Paid subscriptions are billed monthly or annually. You may cancel at any time; access continues until the end of the current billing period. Refunds are handled in accordance with applicable consumer protection laws and app store policies.

12 Intellectual Property

MushingPlan, its logo, design, and proprietary content are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content without permission.

13 Account Termination

We may suspend or terminate your account for violations, fraud, or misuse. Upon termination:

  • You may request export of your personal data (see Privacy Policy)
  • Outstanding marketplace obligations must still be fulfilled
  • You may appeal by contacting [email protected]

14 Limitation of Liability

To the maximum extent permitted by law:

  • MushingPlan is provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to fees paid in the preceding 12 months
  • We specifically disclaim liability for: GPS inaccuracy, offline data loss, wearable data inaccuracy, marketplace disputes, and third-party outages

These limitations do not affect your statutory consumer rights under EU or national law.

15 Indemnification

You agree to indemnify MushingPlan against claims arising from your use of the Service, content you post, or marketplace transactions you conduct, except to the extent caused by our negligence.

16 Governing Law

These Terms are governed by Norwegian law. Disputes will be subject to Norwegian courts. EU consumers retain the right to bring claims in their home jurisdiction as provided by applicable consumer protection regulations.

17 Changes to Terms

We may update these Terms from time to time. Material changes will be communicated with at least 30 days notice through the app or via email. Continued use after changes take effect constitutes acceptance.
